Are Seasonal Workers Covered by Workers’ Compensation?

Are Seasonal Workers Covered by Workers’ Compensation?

If you are injured at work in California, you are covered by Workers’ Compensation (WC). This includes seasonal workers such as those who are employed during peak sales, manufacturing and tourism periods as well as migrant workers who work during planting and harvesting seasons.

In fact, California is one of only 13 U.S. states, and the District of Columbia, Puerto Rico and the Virgin Islands, that require employers to cover seasonal workers for Workers’ Compensation to the same degree as other workers.

WC insurance is an important benefit that can help pay medical and other expenses, as well as help you to avoid loss of income by providing temporary or permanent disability benefits. The benefits will vary based on several factors, including how long you have been employed and how severe your injury is.

Seasonal Workers Experience More Work-Related Injuries

Even though all workers have the right to a safe workplace, seasonal workers have higher injury rates than other full-time workers or those who work for the entire year. Seasonal workers are often unfamiliar with the job site and, because of limited time, may have less on-the-job training. Also, during the holiday season and other high-peaks, retail workers are prone to high-stress levels and fatigue which can make them more susceptible to injury.

All workers can reduce the risk of injury by asking for adequate training. Read all available safety information and get familiar with the workplace. Be vigilant for hazards and report any unsafe workplace conditions.

If You Are Injured at Work

    • Get emergency medical or first aid help right away.
    • Report the accident to your supervisor.
    • Complete a DWC-1 form and submit it to your employer within 30 days of the incident.
    • Take photos of the scene and of your injuries.

Your employer will then file a WC report on your behalf with the insurance company, which will contact you directly. If you don’t hear from them within a reasonable amount of time, or if your WC claim is denied, please contact us! We can help protect your rights in the event of any complication.
