Worker Crushed to Death on 405 Freeway Construction SiteBy Kenton Koszdin Law Office on November 5, 2015 | In Construction Accidents
A Los Angeles construction worker was killed working on the 405 freeway when a 3,000-pound steel beam crushed him. According to a KPCC news report, the fatal construction accident happened on the 405 freeway’s southbound Santa Monica Boulevard exit. Officials say 10 and 15 workers witnessed the steel beam crush the worker. It’s unclear from the report what caused the accident. No other workers were injured.
It is extremely dangerous to work near and below construction beams. Under Statute 1926.759(b) of the Safety and Health Regulations for Construction:
“The controlling contractor shall bar other construction processes below steel erection unless overhead protection for the employees below is provided.”
This means construction employees shouldn’t work below where steel beams are being lifted and attached unless they have adequate protection. When steel beams crush workers, it must be determined who was at-fault, how it could have been prevented, and if there was a failure to provide safe working conditions.
The family of someone killed on the job can pursue compensation for their tragic loss by filing for death benefits through workers’ compensation insurance. Workers’ compensation death benefits in California include $10,000 in burial expenses, and support for lost wages that will continue until the victim’s youngest child turns 18.
In cases involving negligence and wrongdoing, extra support may be available through civil litigation. If you believe that your loved one was killed because of someone else’s negligence, you may be able to pursue compensation by filing a wrongful death claim.
If you’ve lost a loved one in a Los Angeles construction accident, DO NOT hesitate to research your legal rights and options. Filing a claim may be the last thing on your mind, but taking legal action is often the only way to receive fair support for your tragic loss. A Los Angeles workers’ compensation attorney can help ensure that you and your family members get the necessary support to recover financially.
