    A Word About Back Payment Of Disability Benefits

    At times, a claim for Social Security disability benefits involves a determination whether a present or former claimant is entitled to receive a retroactive payment of disability benefits.     Disability benefits are a predetermined payment amount that continues monthly as long as the disability continues. This is in contrast to recipients of Supplemental Security Income (SSI) benefits who receive an amount equal to the maximum amount allowed by Social Security less permissible amounts of income and other assets.

    If an applicant applies for SSI benefits on March 1, 2018, and they are approved, then March 1, 2018, is the first day the applicant may receive any back payment once benefits are awarded. Therefore, if an application for benefits is approved on September 1, 2018, claimants will receive monthly payments for the six-month period that an eligibility decision was pending.

    *Retroactive payment of Social Security Disability Insurance (SSDI)

    Social Security regulations require that an SSDI applicant does not receive any retroactive pay for a five-month waiting period – the first five months of disability. However, applicants are permitted to receive retroactive payment for up to twelve months prior to the date that an SSDI application was filed, of course, provided the applicant was disabled at the time.
